Opotiki District Council recently released its Proposed District Plan for public comment.

Your Community's District Plan

The District Plan applies to all land across our District, regardless of what type of title it is held under. Because of this, Council has taken a practical​ approach to reviewing the Operative Plan.  We want to make the plan clear, concise, easy to interpret and most of all user friendly. 

A key objective of the project is to develop a plan that is representative of our people, our aspirations, our goals and our environment. ​

What is the District Plan?

Every council must have a district plan under the Resource Management Act 1991 (RMA).  The District Plan controls the way we use, subdivide and develop land in the district​.  It identifies where activities can take place, what land can be developed and what features should be protected. ​​

​Summary of Submissions and call for further submissions was publicly notified on Thursday 16 February 2017 and the further submission period closes 4pm, Thursday 2 March 2017. 

Further Submission Notes

This Summary of Decisions Requested has been prepared in accordance with Clause 7 of the First Schedule to the Resource Management Act 1991(RMA).  Further submissions may be made by 4pm on 2 March 2017 as set out below.​

The Proposed Opotiki District Plan was publicly notified on 20 September 2016. The period for submissions closed on 18 November 2016. 

A total of 60 submissions was received, including 2 late submissions. While a decision on the validity of the late submissions will be made by the hearing commissioners in due course, they are included in this summary.

Clause 7 of the RMA requires that a summary is prepared of the decisions requested by submitters.  The Council must provide a public notice of the availability of the summary of decisions requested and where the summary of decisions requested and the submissions can be inspected. All submitters must be served a copy of the public notice and can request a copy of the summary of decisions requested.

Further submissions may be made in support of or opposition to the submissions, as set out in the next section.

Making a Further Submission

Further submissions may only be lodged by the following people:

(a)       any person representing a relevant aspect of the public interest; or
(b)       any person that has an interest in the Proposed Opotiki District Plan greater than the interest that the general public has; or
(c)       Opotiki District Council itself.

Further submissions must be made in accordance with Clause 8 of the RMA. They may only support or oppose points made in submissions already made. Further submissions must be received by 4pm Thursday 2 March 2017.

In supporting or opposing a submission, a further submission must provide reasons for supporting the submission point(s). Form 6 of the Resource Management (Forms, Fees, Procedures) Regulations 2003 or a similar format must be used and all required information provided. The timeframe for lodging further submissions is ten working days. Therefore the closing date for lodging further submissions will be 4pm Thursday 2 March 2017 - ten working days from the date of public notification which is 16 February 2017.

Further submissions can be made in writing (hard copy or electronic) and must be received by Opotiki District Council by 4pm Thursday 2 March 2017 to the following addresses:

  • Posted to: Chief Executive, Opotiki District Council, PO Box 44, Opotiki. 
  • Deliver to Council offices, 108 St John Street, Opotiki.

A copy of a further submission must be provided to the person or organisation who made the original submission within 5 working days of lodging the further submission with the Council. Submitters' names and contact details are provided below.

After 4pm Thursday 2 March 2017 the Council will start work on analysing all submissions and further submissions. If a submitter or further submitter has asked to be heard by the Council hearing committee, a hearing will be held. A report on all submissions will be sent to all parties who have lodged submissions or further submissions and have requested to be heard.

When the Council has made its decisions on submissions, a public notice must be given and a copy sent to every person who made a submission or further submission, with reasons for accepting or rejecting the submission.

There is a right of appeal to the Environment Court for people who have lodged submissions and further submissions.
